1. Acceptance of Terms

By downloading, installing, accessing, or using Keyboard Themes – Fonts, Emoji (the "App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree with any part of these Terms, please do not download or use the App.

These Terms form a legally binding agreement between you ("User," "you," or "your") and Rashmi Varsani ("we," "us," or "our"), the developer and publisher of the App.

2. Eligibility

You must be at least 13 years old (or 16 years old in the European Economic Area) to use this App. By using the App, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

3. App Purpose

Keyboard Themes – Fonts, Emoji is a custom iOS keyboard application that allows users to personalize their typing experience. The App provides:

• Custom keyboard themes, wallpapers, and color schemes
• A wide selection of fonts and stylish text styles
• Emoji, stickers, kaomoji, and symbol libraries
• Auto-correct, predictive text suggestions, and swipe typing
• Sound and haptic feedback customization
• Keyboard layout and language preferences

👉 The App is intended for personal, non-commercial use only.

4. License to Use the App

We grant you a limited, non-exclusive, non-transferable, revocable license to download and use the App on Apple devices that you own or control, solely for your personal, non-commercial use, and strictly in accordance with these Terms and Apple’s App Store Terms of Service.

5. Subscriptions and Payments

The App offers optional premium subscriptions with the following pricing:

• Weekly Subscription with 3-Day Free Trial — $9.99 / week
• Weekly Subscription — $9.99 / week
• Yearly Subscription — $79.99 / year

Prices may vary by country or region and will be displayed in your local currency at the time of purchase.

5.1 Subscription Terms

• Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period.
• Payment is charged to your Apple ID account at confirmation of purchase.
• Your account will be charged for renewal within 24 hours prior to the end of the current period.
• The free trial automatically converts into a paid subscription unless canceled at least 24 hours before the trial ends.
• Any unused portion of a free trial is forfeited upon purchasing a subscription.
• Manage or cancel subscriptions at any time via your device: Settings → [Your Name] → Subscriptions.
• All payments and refund requests are handled by Apple. We do not process payments directly.

6. User Responsibilities

You agree NOT to:

• Use the App for any illegal, fraudulent, or unauthorized purpose
• Use the App to send spam, harassing, threatening, abusive, hateful, or offensive content
• Reverse-engineer, decompile, disassemble, modify, or create derivative works of the App
• Attempt to extract source code, themes, fonts, or other proprietary content for redistribution
• Use the App to transmit malware, viruses, or any malicious code
• Bypass, disable, or interfere with security features or subscription mechanisms
• Resell, sublicense, rent, or commercially exploit the App or its content
• Use automated scripts, bots, or scrapers to access the App
• Impersonate any person or misrepresent your affiliation with any entity
• Violate any applicable local, national, or international law or regulation

7. Intellectual Property Rights

All content within the App — including themes, wallpapers, fonts, icons, designs, graphics, code, trademarks, logos, and other materials — is the property of Rashmi Varsani or its licensors and is protected by copyright, trademark, and other intellectual property laws.

You are granted no rights or licenses other than the limited right to use the App as described in these Terms. Any unauthorized use, reproduction, or distribution of App content is strictly prohibited.

8. Content You Type

You retain full ownership of any text or content you type using the App. We do not record, store, monitor, or claim any rights over your typed content. Secure fields (such as passwords and payment information) are automatically protected by iOS and are inaccessible to the App.

9. Device Compatibility

The App is designed for iOS devices. We do not guarantee that the App will be compatible with all iOS versions, device models, or third-party apps. Some features may not function as expected on older devices or unsupported iOS versions.

10. Third-Party Services and Apps

The App may interact with third-party apps (e.g., messaging apps, social media apps) where the keyboard is used. We are not responsible for the functionality, content, privacy practices, or terms of any third-party services. Your use of third-party apps is subject to their respective terms and policies.

11. Advertisements

The free version of the App may display advertisements provided by third-party advertising networks. We are not responsible for the content of advertisements or for any products or services advertised. Premium subscribers enjoy an ad-free experience.

12. Updates and Modifications to the App

We may release updates, patches, or new versions of the App from time to time. We reserve the right to modify, suspend, or discontinue the App (or any features, themes, or content within it) at any time, with or without notice. We are not liable for any modification, suspension, or discontinuation of the App.

13. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• No guarantee of uninterrupted, error-free, or secure operation
• No guarantee of compatibility with all devices or iOS versions
• No warranties of merchantability, fitness for a particular purpose, or non-infringement
• No guarantee that defects will be corrected

Your use of the App is at your own risk.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL RASHMI VARSANI, OUR AFFILIATES, OR OUR LICENSORS BE LIABLE FOR ANY:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of data, profits, revenue, or business opportunities
• Device malfunctions, app crashes, or performance issues
• Typing errors, auto-correct mistakes, or predictive text inaccuracies
• Issues arising from third-party apps where the keyboard is used
• Unauthorized access to or use of your device

Our total liability for any claim arising out of or relating to these Terms or the App shall not exceed the amount you paid us, if any, in the twelve (12) months preceding the claim.

15. Indemnification

You agree to indemnify, defend, and hold harmless Rashmi Varsani and our affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the App, your violation of these Terms, or your violation of any rights of a third party.

16. Termination

We reserve the right, at our sole discretion, to suspend or terminate your access to the App at any time, without notice, if you violate these Terms or engage in any conduct we deem inappropriate or harmful. Upon termination, your right to use the App will cease immediately.

You may stop using the App at any time by uninstalling it from your device. Termination does not entitle you to a refund of any subscription fees, which remain governed by Apple’s refund policy.

17. Apple-Specific Terms

You acknowledge that these Terms are between you and Rashmi Varsani only, and not with Apple Inc. Apple is not responsible for the App or its content. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any). Apple has no other warranty obligations whatsoever with respect to the App.

Apple and Apple’s subsidiaries are third-party beneficiaries of these Terms and have the right to enforce them against you.

18. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of laws principles. Any disputes arising out of or relating to these Terms or the App shall be resolved through good-faith negotiations, and if not resolved, through binding arbitration or in the competent courts of Ahmedabad, Gujarat, India.

19. Changes to These Terms

We may update these Terms at any time to reflect changes in our practices, features, or legal requirements. The "Effective Date" at the top of this document indicates when the latest version takes effect. Continued use of the App after changes are posted constitutes your acceptance of the updated Terms. If you do not agree with the updated Terms, you must stop using the App.

20. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

21. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the App and supersede any prior agreements, communications, or understandings.
